Marijuana commerce group sues to stop 24% tax from going into impact

GRAND RAPIDS, Mich. (WOOD) — A commerce affiliation representing Michigan marijuana outlets is suing the state, arguing a 24% wholesale tax on marijuana that is a part of the brand new finances is unconstitutional and in search of to get it thrown out.

The Michigan Hashish Business Affiliation on Tuesday filed its lawsuit within the Courtroom of Claims towards the state of Michigan, the Division of the Treasury and the state treasurer.

The swimsuit challenges the Complete Highway Funding Tax Act, which the Michigan Legislature handed Sept. 30 and the governor signed Tuesday. It argues that the CRFTA is illegal as a result of new excise taxes on marijuana ought to come as amendments to the 2018 Michigan Regulation and Tax of Marihuana Act, which would wish a three-fourths vote within the Legislature or direct approval by voters.

“By purporting to levy an additional 24 percent excise tax on top of the existing ten percent rate established by MRTMA, CRFTA creates a significantly cumulative excise tax burden that not only defies the will of the voters, but it also invades MRTMA’s exclusive authority over excise taxes,” the swimsuit says.

The swimsuit goes on to argue that the rule was misleadingly labeled when it was launched to the Legislature as a result of it contained no reference to marijuana and mentioned solely that the income collected would go to roads. It says the contents of the invoice had been “fundamentally altered, resulting in a final version that bore practically no resemblance to the introduced version…”

“These sweeping changes … constitute an unlawful and unconstitutional change of purpose,” the swimsuit reads partly.

The swimsuit additionally says implementation of the legislation would have an effect on standing contracts that marijuana shops have with suppliers, which it says it unlawful.

Tax hike worries Michigan hashish business

“(The Michigan Cannabis Industry Association) contends that CRFTA’s numerous constitutional deficiencies render the act invalid and unenforceable as a matter of law,” the swimsuit says.

It asks the courtroom to rule to that impact and inform the federal government the brand new tax is probably not enforced.

For now, the 24% wholesale marijuana excise tax is scheduled to enter impact Jan. 1 and is predicted to usher in about $420 million for roads.
