Lawsuit: Grand Rapids lady discovered lifeless mouse in Monster Power drink

Lawsuit: Grand Rapids lady discovered lifeless mouse in Monster Power drink

GRAND RAPIDS, Mich. (WOOD) — A Grand Rapids resident is suing Monster Beverage Company, alleging that she drank a Monster Power drink after which found a lifeless mouse contained in the can.

In line with the lawsuit, which was beforehand filed in state court docket however was transferred to federal court docket final week, the girl purchased the vitality drink from a store in Grand Rapids in April 2024.

“Upon consuming the drink, (she) picked up the can and realized the can was still oddly heavy,” the lawsuit says. “Out of curiosity, (she) opened the can further, and to her horror, found a dead mouse laying in the bottom of the can.”

The alleged discovery triggered “severe emotional distress, trauma, and physical illness” and led to medical bills for therapy and counseling, in response to the criticism.

The lawsuit accuses Monster of negligence, strict legal responsibility, and breach of implied guarantee of merchantability.

“Monster’s product has been shown to be defective — a dead mouse in the bottom of a can is a clear and massive deviation from its intended design,” it says.

This isn’t the primary lawsuit of its variety. Greater than a decade in the past, a Washington man claimed he discovered a lifeless mouse on the backside of a Monster Power drink, in response to a report from NBC. Monster termed the 2011 lawsuit “nothing more than a shakedown” and mentioned there was no factual foundation for the declare.
