AG: Lawsuit towards 'misleading' tree corporations resolved

LANSING, Mich. (WLNS) — A lawsuit the state filed towards a number of tree service corporations accused of deceiving clients searching for storm clean-up companies has been resolved, Michigan Lawyer Basic Dana Nessel introduced Wednesday.

In 2024, Nessel filed go well with towards Florida-based firm Canary Tree Service and its proprietor, Justin Hartmann, claiming that the enterprise recruited a number of corporations to conduct storm clean-up in Oakland and Washtenaw counties in the course of the summer season of 2021 and in Gaylord after the Could 2022 twister.

These corporations included the Mississippi-based Garrison McKinney Tree and Bridge Service and the Michigan-based Holtslander and Sons Tree Service.

The lawsuit claimed that the businesses misled their clients about the price of the companies, potential monetary duties for prices not lined by insurance coverage, the character of the agreements they had been signing, and their authorized rights and obligations. Moreover, Canary was accused of worth gouging customers affected by extreme climate when the demand for his or her companies was excessive.

Additional, Nessel accused Holtslander and Sons of comparable practices in 2023 in Genesse County, and the Division of Lawyer Basic later recognized extra victims of their conduct amongst these affected by the 2024 Kalamazoo twister.

A default judgment towards Canary and its proprietor Hartmann was secured after each failed to answer the go well with and stopped enterprise operations in the course of the investigation. Below the phrases of the judgment, neither can conduct enterprise in Michigan and former clients will not be accountable for unpaid invoices to Canary not lined by insurance coverage.

The state reached a settlement with Garrison McKinney, who denied the allegations int eh lawsuit, requiring that they supply worth quotes to any Michigan customers earlier than performing any future emergency companies.

A ruling in April 2025 concluded that Holtslander and Sons had violated the Michigan Client Safety Act. A settlement reached final week requires that the corporate take away contract phrases claimed to be illegal, present written quotes to customers earlier than emergency tree companies are rendered, and remove deceptive data from its web site.

Moreover, the corporate is not going to try to gather cost for sure previous companies and can pay the state $25,000 — of which a portion might be distributed to victims.

“When severe weather strikes, Michigan consumers deserve honest help, not misleading contracts or inflated prices,” Nessel mentioned. “My office remains committed to protecting Michiganders from deceptive business practices, especially in the aftermath of disasters.”
